As the original owner, you are entitled to a 3 year warranty on our parts and labor.  This warranty does not include tubes or speakers.  Tamerlane Amplifiers will solely determine if your amplifier shall be covered under our warranty.  Tamerlane Amplifiers is not obligated to honor a warranty in the event of abuse, misuse, or accident to the amplifier.   As the original owner, you are responsible for all shipping and insurance charges to and from Tamerlane Amplifiers in the event that we need to honor a warranty issue on your amplifier.  All amplifiers shall be returned insured to validate the warranty.  This warranty will be void if repairs or modifications have been attempted or performed by anyone other than Tamerlane Amplifiers. 

Our amplifiers are hand built one at a time to specific order.  We do not offer returns or refunds on custom orders.  Please check out our pictures and sound clips that we have provided for you as a reference to what you can expect from your purchase.  Our amplifiers are based on vintage circuits which we have improved by our modifications into the amplifiers that we offer today.  We want you to be happy with your Tamerlane Amplifier.  If you are not happy with the tone of your amplifier, we will be happy to work with you as the registered original owner to determine what modifications can be done to fit the amplifier to your tone requirements. 

All equipment and material not manufactured by Tamerlane has only the warranty given it by the respective manufacturer of such equipment or material to the extent Tamerlane has the right to pass-through such warranty to Buyer, and no other warranties shall apply, whether express or implied.  Remedies for breach of warranty are limited specifically to those remedies contained in the affected manufacturer's warranty.

"Goods prepared or manufactured by Tamerlane in accordance with drawings and/or specifications prepared by Buyer are sold "AS IS" and shall have no warranty except for those explicitly stated herein.

"Each item of equipment or goods solely developed or manufactured by Tamerlane shall be free from defects in material and workmanship for a period of three (3) years from date of shipment of such item from Tamerlane.

"Tamerlane's sole and exclusive liability on any warranty claim by Buyer against the express warranty given by Tamerlane is, at the sole option of Tamerlane, to repair, replace or credit Buyer's account for the documented cost of such goods. Tamerlane's liability is specifically conditioned upon Buyer (a) promptly notifying Tamerlane, in writing, with a detailed description of how and why the goods fail to conform to the obligations of this Agreement; and (b) returning the goods, freight prepaid, to Tamerlane and also freight prepaid back to Buyer.

 

Tamerlane shall then examine such goods and make a final and conclusive determination as to whether or not the goods are deficient in the manner expressed, in writing, by Buyer and that such deficiencies were not caused in whole or in part by accident, misuse, neglect, alteration, shipping, improper installation, repair by others, improper operation or testing, or any other causes unrelated to workmanlike manufacture and defect-free materials. Such repair or replacement by Tamerlane will be accomplished within a reasonable time after receipt by Tamerlane of the item taking into account Tamerlane's then existing work load and demands on Tamerlane's time. Replacement parts will be covered by warranty for only the unexpired warranty of the original part.

"TAMERLANE MAKES NO OTHER EXPRESS WARRANTY (EXCEPT SUCH EXPRESS WARRANTIES, IF ANY, AS MAY BE MADE IN ANY WRITTEN PROPOSAL TO BUYER, OR IN ANY SEPARATE WRITTEN WARRANTY DELIVERED TO BUYER, AND THEN ONLY WHEN SUCH PROPOSAL OR SEPARATE WARRANTY IS SIGNED BY A DULY AUTHORIZED OFFICER OF TAMERLANE), AND TAMERLANE MAKES NO IMPLIED WARRANTIES WITH RESPECT TO SUCH EQUIPMENT. 

"TAMERLANE HEREBY SPECIFICALLY AND EXPRESSLY DISCLAIMS ANY OTHER WARRANTY BY IT, EXPRESS (other than those warranties described herein) OR IMPLIED, STATUTORY, BY OPERATION OF LAW OR OTHERWISE, INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. 

"Buyer hereby covenants and agrees that it has no right or remedy against Tamerlane, including, but not limited to, claims for INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, FOR ANY CAUSE, LOSS, ACTION, CLAIM OR DEMAND WHATSOEVER, OR INJURY TO PERSON OR PROPERTY OR ANY OTHER CONSEQUENTIAL, ECONOMIC OR INCIDENTAL LOSS arising out of or related in any manner to any item purchased hereunder, even if Tamerlane has been advised of the possibility of such damage or loss. Buyer expressly agrees that the SOLE AND EXCLUSIVE right and remedy of Buyer is limited to an action or claim against the manufacturer of goods not manufactured by Tamerlane.

 "The foregoing shall be the limit of Tamerlane's liability, and Buyer's exclusive remedy for any breach of warranty. Tamerlane neither assumes nor authorizes any person to assume for it any other liability in connection with the sale of goods. Tamerlane's total liability for any claim arising as a result of, or related to, any goods whether in contract, tort (including negligence or strict liability), under any warranty or otherwise, shall in no event exceed an amount equal to the amount paid to Tamerlane for the particular goods, the use or performance of which gives rise to the claim.
